Cheshire East Decision Document – Bunbury Neighbourhood Plan is ‘Made’

On 29th March 2016 Cheshire East Council decided to make the Bunbury Neighbourhood Plan under 38A(4)(a) of the Planning and Compulsory Purchase Act 2004. The Bunbury Neighbourhood Plan now forms part of the Development Plan for Cheshire East Council.

Regulation 18 – Publication of Examiners Report

Under Regulation 18 of The Neighbourhood Planning (General) Regulations 2012, the Independent Examiners report is now published

The Bunbury Neighbourhood Plan has been Independently Examined and the Examiner has reached a view  by considering written representations (see paragraph 9(1) of Schedule 4B to the Town and Country Planning Act 1990 (as amended)).

The Bunbury Neighbourhood Plan was approved by Bunbury Parish Council on 19th August 2015 and submitted to Cheshire East Council on 28th August 2015

About the Documents

These documents are the key components of the submission version of the Bunbury Neighbourhood Plan. In accordance with Regulation 15 of The Neighbourhood Planning (General) Regulations 2012, Bunbury Parish Council, as the qualifying body, has submitted to Cheshire East Council, the Local Planning Authority, the submission version of the Bunbury Neighbourhood Plan for consideration and wider publicity.

The submission meets the Regulation 15 criteria as follows:

15. (1) Where a qualifying body submits a plan proposal to the Local Planning Authority, it must include:

(a) A map or statement which identifies the area to which the propose Neighbourhood Plan relates; this is contained in Appendix ‘C’ (Page 46) of the Submission Plan below

(b) A Consultation Statement; which details the information required by Regulation 15. (2) (a), (b), (c), and (d) below; this is the Consultation Statement below

(c) The proposed Neighbourhood Plan; this is the Submission Plan below

(d) A statement explaining how the proposed Neighbourhood Plan meets the requirements of paragraph 8 of Schedule 4B to the 1990 Act; this is  the Basic Conditions Statement below

15 (2) In this regulation “Consultation Statement” means a document which:

(a) Provides details of the persons and bodies who were consulted about the proposed neighbourhood plan

(b) Explains how they were consulted

(c) Summarises the main issues and concerns raised by the persons consulted

(d) Describes how these issues and concerns have been considered and, where relevant, were addressed in the proposed neighbourhood plan

The Screening Assessment came to the conclusion that the Bunbury Neighbourhood Plan is not likely to have significant adverse effects, either alone or in-combination with other plans and projects, on the integrity of any identified European Sites.

Bunbury Neighbourhood Plan Group Amended Constitution

The Constitution has been amended because Councillor Eric Lord resigned from Bunbury Parish Council and the Bunbury Neighbourhood Plan Group (BNPG). Because of the advanced stage of the plan it was decided that Eric would not be replaced on the BNPG and the constitution was amended accordingly, with its membership now comprising three Parish Councillors and up to four individuals who are resident or work within the parish

Policy Survey Results

Here are all the results taken from the responses to the Policy Survey. See links below to the results and the survey document. The results will help us to write the final version of the Neighbourhood Plan, which will be delivered to every home in the village and sent to Cheshire East for the final consultation stage. Cheshire East will then send the Plan to an Independent Examiner. After the examiners views of the plan are considered a referendum will be held, providing residents with an opportunity to vote on the Plan.
